TERMS AND CONDITIONS OF SALE AND USE

SECTION 1 - ONLINE STORE TERMS

By agreeing to these Terms, you represent that you are at least the age of majority in your state or province of residence. The use of our products for any illegal or unauthorized purpose is prohibited. Any violation of the terms will result in an immediate termination of your Services.

SECTION 2 - GENERAL CONDITIONS

We reserve the right to refuse service to anyone for any reason at any time. Your data (excluding credit card information) may be transferred unencrypted. Payment information is always encrypted.

SECTION 3 - ACCURACY, COMPLETENESS AND TIMELINESS OF INFORMATION

We are not responsible if information made available on this site is inaccurate or out of date. The content is provided for general information only.

SECTION 4 - MODIFICATIONS TO THE SERVICE AND PRICES

Prices for our products are subject to change without notice. We reserve the right at any time to modify or discontinue the Service without liability to you or any third-party.

SECTION 5 - PRODUCTS OR SERVICES (Lingerie & Hygiene)

All products are exclusive to the Site.

HYGIENE PROTECTION: In accordance with Article L221-28 of the French Consumer Code, lingerie items that have been unsealed or tried on cannot be returned for reasons of hygiene. Returns are only accepted for new products, in their original packaging, and with all tags attached.

SECTION 6 - ACCURACY OF BILLING AND ACCOUNT INFORMATION

We reserve the right to refuse any order you place with us. In the event of a change or cancellation, we will contact you via e-mail. You agree to provide current, complete, and accurate account information.

SECTION 7 - OPTIONAL TOOLS

We may provide access to third-party tools (e.g., trackers) over which we have no control. Use of these tools is at your own risk.

SECTION 8 - THIRD-PARTY LINKS

We are not responsible for the content of third-party websites accessible via our site. Please review their policies before engaging in any transaction.

SECTION 10 - PERSONAL INFORMATION

The processing of your personal data is governed by our Privacy Policy (GDPR compliant).

SECTION 11 - ERRORS, INACCURACIES AND OMISSIONS

In the event of a typographical error regarding price or description, we reserve the right to correct the error and cancel an order, even after validation.

SECTION 12 - PROHIBITED USES

You are prohibited from using the site for unlawful purposes, to harass others, or to transmit computer viruses.

SECTION 13 - LEGAL WARRANTIES AND LIMITATION OF LIABILITY

In accordance with French law, we are liable for defects in conformity (Legal Warranty of 2 years) and hidden defects of the product. Aside from these warranties, the service is provided "as is". Our liability is limited to the amount of the purchase.

SECTION 14 - RIGHT OF WITHDRAWAL

You have 14 days to change your mind, except for the hygiene exceptions mentioned in Section 5. Return shipping costs are the responsibility of the customer unless the product is proven defective.

SECTION 15 - INDEMNIFICATION

You agree to indemnify lolaluna lingerie (SARL Eléments Précieux) in the event of a third-party claim resulting from your breach of these terms.

SECTION 16 - SEVERABILITY

If any provision is found to be invalid, the remaining provisions shall remain in full force and effect.

SECTION 17 - TERMINATION

Obligations incurred prior to the termination date shall remain due. You may terminate these terms by ceasing to use our site.

SECTION 18 - CONSUMER MEDIATION

In accordance with the French Consumer Code, for any dispute not resolved by our customer service (contact@lolaluna.com), you may contact a consumer mediator free of charge.

SECTION 19 - GOVERNING LAW

These terms are governed by the laws of France. Any dispute will be brought before the competent French courts.

Unsure about your size? Our designs are crafted with stretchy and adjustable materials to perfectly embrace your curves. If you are between two sizes, we recommend choosing the larger one.

We encourage our customers to contact us if they are unsure about sizing before placing an order or if they have any other questions. 
However, exchanges and/or credits are very acceptable without any problem.

Return Policy

1. Right of Withdrawal

In accordance with current legislation, you have a period of 14 days from the receipt of your order to return a product. If this period has passed, we unfortunately cannot offer you a refund or exchange.

2. Return Conditions (Hygiene)

To be eligible for a return, your item must be unused, unworn, and in the same condition as you received it.

Important Note: Given the nature of our products (lingerie), items returned for hygiene reasons must strictly be in their original packaging, with all labels and protective strips intact. Any item that has been worn, washed, or damaged will not be refunded.

3. Exchanges

We replace items if they are defective, damaged, or if you need a different size. For an exchange, please email us at contact@lolaluna.com  and return your item to the address listed below.

4. Shipping and Return Costs

We do not provide prepaid return labels. You will be responsible for paying your own shipping costs for returning your item. Shipping costs are non-refundable. If you receive a refund, the original shipping costs of the order will not be included (except in the case of a defective product).
